Terms and Conditions

1. Scope and Services

1.1 These Terms and Conditions govern the use of the online platform rideoutclub.com (hereinafter "Platform"), operated by Tim Dethlefsen and Tyll Liu-Albinger (hereinafter "Operator").

1.2 The Platform serves as an intermediary between customers (hereinafter "Customer") and bicycle rental companies (hereinafter "Rental Partners"). The Operator facilitates the booking of bicycles but is not a party to the rental agreement itself.

1.3 The rental agreement is concluded directly between the Customer and the respective Rental Partner. The Operator acts solely as an intermediary.

2. Use of the Platform

2.1 Use of the Platform is free of charge for Customers.

2.2 The Customer can search for available bicycles via the Platform and make bookings with Rental Partners.

2.3 The Operator reserves the right to restrict or terminate access to the Platform at any time without prior notice, particularly in case of misuse or violation of these Terms and Conditions.

3. Booking Process

3.1 By clicking the booking button, the Customer submits a binding booking request to the respective Rental Partner.

3.2 The rental agreement is concluded when the Rental Partner confirms the booking. The Customer will receive a booking confirmation by email.

3.3 The specific rental conditions (prices, rental period, cancellation conditions, deposit, insurance, etc.) are determined by the respective Rental Partner and communicated during the booking process.

4. Prices and Payment

4.1 All prices stated on the Platform are set by the Rental Partners and include statutory VAT.

4.2 Payment is made directly to the Rental Partner according to their payment terms. The Operator does not process payments.

4.3 The Operator receives a commission from Rental Partners for successfully mediated bookings. This does not affect the rental price for the Customer.

5. Right of Withdrawal

5.1 For rental agreements concluded via the Platform, the statutory right of withdrawal applies in accordance with § 312g para. 2 sentence 1 no. 9 BGB (German Civil Code). The right of withdrawal expires if the Rental Partner has fully performed the service with the Customer's express consent before the end of the withdrawal period.

5.2 Specific cancellation conditions of the Rental Partner apply and will be communicated during the booking process.

6. Liability and Disclaimer

6.1 The Operator is only liable for damages caused intentionally or through gross negligence by the Operator, its legal representatives, or vicarious agents.

6.2 The Operator assumes no liability for:

  • The quality, safety, or condition of the rented bicycles
  • Damages occurring during bicycle use
  • Accidents, injuries, or health issues during bicycle use
  • Loss or theft of rented bicycles or personal belongings
  • Compliance with traffic regulations by Customers
  • Accuracy and completeness of information provided by Rental Partners

6.3 The rental agreement is concluded exclusively between Customer and Rental Partner. All claims arising from the rental relationship (defects, damages, accidents, etc.) must be directed to the Rental Partner.

6.4 The Customer is responsible for ensuring they possess the necessary physical fitness and skills for cycling. Cycling involves inherent risks that the Customer assumes voluntarily.

6.5 The Operator is not liable for the availability of the Platform or for technical disruptions, unless caused by intentional or grossly negligent conduct.

6.6 The Operator assumes no liability for content, services, or conduct of Rental Partners.

7. Customer Obligations

7.1 The Customer is obligated to:

  • Provide accurate and complete information during the booking process
  • Comply with the rental conditions of the respective Rental Partner
  • Handle the rented bicycle with care
  • Comply with applicable traffic regulations
  • Report damages or defects to the Rental Partner immediately
  • Use appropriate safety equipment (helmet, lights, etc.)

7.2 The Customer is liable for all damages caused by improper use or violation of rental conditions.

8. Data Protection

8.1 The collection, processing, and use of personal data is governed by our Privacy Policy, which can be found at: Privacy Policy

9. Changes to Terms and Conditions

9.1 The Operator reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to Customers via the Platform or by email.

9.2 Continued use of the Platform after changes have been announced constitutes acceptance of the modified Terms and Conditions.

10. Severability Clause

10.1 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.

11. Applicable Law and Jurisdiction

11.1 These Terms and Conditions and all legal relationships between the Operator and the Customer are governed exclusively by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 If the Customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is Berlin, Germany.

11.3 For consumers, the statutory provisions regarding jurisdiction apply.
